These Terms of Service ("Terms") are a binding agreement between you and Phasly ("Phasly", "we", "us"). By creating an account, joining the early-access list, or using our website or apps (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to use Phasly, and able to form a binding contract. If you use the Service on behalf of someone else, you confirm you're authorised to do so.
Phasly provides cycle tracking and personalised, phase-aware and check-in-aware fitness guidance and coaching. Before public launch, parts of the Service may be offered as a waitlist, early-access or beta programme. Pre-launch features may change, may not work perfectly, and may be added or removed as we develop the product. Founding-member offers are described on our website and may be limited in number or time.
Phasly is not a medical service and does not provide medical advice. Content, training plans, cycle predictions, fertile-window estimates and pregnancy-chance read-outs are for general informational and wellbeing purposes only, are not guaranteed to be accurate, and are not a substitute for advice from a qualified doctor or health professional.
You're responsible for keeping your login credentials secure and for activity under your account. Tell us promptly at hello@phasly.com if you suspect unauthorised use. Please give accurate information and keep it up to date.
You agree not to: misuse, disrupt, reverse-engineer or attempt to gain unauthorised access to the Service; use it unlawfully or to infringe others' rights; upload harmful code; scrape or copy the Service or its content except as allowed; or resell or commercially exploit the Service without our permission.
The Service, including its software, design, branding ("Phasly") and content, is owned by us or our licensors and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. You keep ownership of the data and content you create; see "Your data" below.
You own the health, cycle and fitness data you log. We process it to provide and improve the Service as described in our Privacy Policy. You can export or delete your data, and you grant us the limited rights needed to store, process and display it back to you for that purpose.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't guarantee the Service will be uninterrupted, error-free, or that any prediction or recommendation will be accurate or suitable for you.
To the maximum extent permitted by law, Phasly and its team will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence). Where liability cannot be fully excluded, our total liability is limited to the amount you paid us in the 12 months before the claim.
You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.
These Terms are governed by the laws of the jurisdiction in which Phasly is established, without regard to conflict-of-law rules, and the courts of that jurisdiction will have exclusive jurisdiction, unless mandatory local consumer-protection laws give you additional rights. (The specific governing law and venue will be confirmed once Phasly's legal entity is registered.)
We may update these Terms as the Service evolves. If we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.
